1. Introduction / Introduction

These Terms & Conditions (“Terms”) govern your use of this website (the “Site”) operated by JFT Auto (“we,” “us,” or “our”) and any services, including vehicle leasing, offered by us. By accessing or using the Site or entering into any lease or service agreement with us, you accept and agree to these Terms.

If you do not agree with any part of these Terms, do not use the Site or lease from us.

2. Definitions / Définitions

Some terms used in these Terms & Conditions include:

  • Lessee / locataire: the individual or entity leasing the vehicle from us.

  • Lessor / bailleur: JFT Auto or its assigns, the party granting the lease.

  • Lease / bail: a contract by which the Lessor grants the Lessee the right to use a vehicle for a specified period under terms & conditions.

  • Vehicle / véhicule: the motor vehicle subject to a lease agreement, as described in the lease.

  • Site: the website jftauto.ca, plus any related apps or digital platforms.

  • Services: includes leasing, maintenance, repairs, financing, and related services offered by us.

3. Use of the Site / Utilisation du site

  1. You agree to use the Site only for lawful purposes and in a manner that does not infringe rights or restrict or inhibit others’ use.

  2. We may suspend or terminate access to parts or the entirety of the Site at any time, without notice, for maintenance or violation of these Terms.

  3. All content, design, and materials on the Site are protected by copyright and other intellectual property laws. You may not copy, distribute, or modify them without our express consent.

4. Vehicle Leasing Terms / Conditions de location du véhicule

4.1 Lease Agreement

  • All leases will be documented in a separate written agreement (the “Lease Contract”) which will prevail over these general Terms in case of conflict.

  • The Lease Contract must detail the vehicle (make, model, year, VIN), lease term, monthly payments, residual value, permitted kilometers, maintenance obligations, insurance, penalties, etc.

4.2 Lease Term and Payments

  • The lease term begins on the date stated in the Lease Contract and continues for the full period unless terminated earlier under the contract.

  • Lessee must make monthly payments in the amount and by the method specified, on or before the due date.

  • Late payments may incur interest or penalties as agreed in the Lease Contract.

4.3 Security Deposit / Dépôt de garantie

  • A security deposit (if required) will be held by Lessor, and may be used to cover unpaid amounts, damage, or other charges under the lease.

  • After lease termination and after all deductions, any remaining portion of the deposit will be returned within a specified timeframe.

4.4 Insurance; Liability

  • The Lessee must maintain insurance coverage (liability, collision, comprehensive, etc.) as required by law and as specified in the Lease Contract.

  • The Lessor may require that it be named as an additional insured or loss payee.

  • The Lessee is responsible for any damage, fines, or loss to the vehicle not covered by insurance, subject to the Lease Contract.

4.5 Maintenance, Repairs & Use

  • The Lessee agrees to maintain the vehicle in good condition, follow the manufacturer’s maintenance schedule, and perform timely repairs.

  • Use of the vehicle must comply with laws, and is subject to restrictions in the Lease Contract (e.g. mileage limits, prohibited uses).

  • The Lessee must notify the Lessor of any damage or required repairs and allow inspection.

4.6 Excess Use, Wear & Tear

  • At lease end, the vehicle must be returned in condition consistent with “normal wear and tear” (as defined in the Lease Contract).

  • Charges may apply for excess mileage or damage beyond acceptable wear and tear, at rates stated in the Lease Contract.

4.7 Early Termination & Default

  • The Lessee may terminate early subject to conditions and penalties detailed in the Lease Contract.

  • If the Lessee defaults (missed payments, breach of obligations, insurance lapse, etc.), the Lessor may terminate the lease, repossess the vehicle, and seek recovery of amounts owing, including legal costs.

4.8 End-of-Lease Options

  • If a purchase option is offered, the terms (price, deadlines, conditions) must be clearly specified in the Lease Contract.

  • Upon lease end, the Lessee returns the vehicle, or exercises any purchase option, as applicable.

5. Limitation of Liability / Limitation de responsabilité

  • To the maximum extent permitted by law, JFT Auto and its affiliates are not liable for indirect, incidental, special, punitive, or consequential damages arising from use of the Site, service interruptions, or leasing operations.

  • Our total liability under these Terms or any Lease Contract is limited to the amounts you have paid us under the applicable contract.

6. Indemnification / Indemnisation

You agree to indemnify, defend, and hold harmless JFT Auto, its agents, and employees from any claims, damages, losses, liabilities, costs or expenses (including legal fees) arising out of your breach of these Terms, misuse of the Site or violation of any law.

7. Privacy & Data / Confidentialité & données

Your personal information will be collected, used, and protected in accordance with our Privacy Policy, which is incorporated by reference into these Terms. (Link to Privacy Policy page.)

8. Third-Party Services / Services de tiers

  • The Site may contain links to third-party websites or services. We are not responsible for their content, practices, or terms.

  • Use of third-party services (such as financing, insurance, mapping) is subject to those providers’ terms.

9. Modification / Amendments / Modifications

We reserve the right to modify or replace these Terms at any time. We will post the updated Terms on the Site and update the “Last Updated” date. Continued use of the Site or leasing services after changes indicates acceptance of the new Terms.

10. Governing Law & Dispute Resolution / Droit applicable & résolution des litiges

  • These Terms (and any Lease Contracts) are governed by the laws of the Province of Québec and the federal laws of Canada applicable therein.

  • Any disputes shall be resolved by the courts of the jurisdiction in which JFT Auto has its principal place of business (unless otherwise required by law).

  • If any provision is found invalid or unenforceable, that provision shall be severed, and the remainder shall continue in full force and effect.

11. Miscellaneous / Dispositions diverses

  • Entire Agreement / Accord complet: These Terms, together with any Lease Contract, constitute the entire agreement between you and us concerning their subject matter.

  • No Waiver / Non-renonciation: Our failure to enforce a right under these Terms does not constitute waiver of that right.

  • Assignment / Cession: We may assign or transfer our rights and obligations under these Terms or under Lease Contracts without your consent.

  • Notices / Avis: Notices may be delivered by email, mail, or posted on the Site, as specified in the Lease Contract.

  • Headings / Titres: Headings are for convenience only and do not affect interpretation.
